Many people ask me what is going to happen to the children while the divorce is pending. If you and your spouse are still living in the same house, then we don’t address those issues while the divorce is pending. We’ll address what’s going to happen when the divorce is over and you no longer live with your spouse. If, during the divorce, you and your spouse no longer live together, we’ll typically try to come up with an agreement on when each parent is going to see the children and when they’re going to have time with the children.

Custody After Divorce

Custody is decided by the court in the best interests of the children. All the circumstances surrounding the children will be considered. There can be either joint or sole custody awarded to the parent that is determined to provide the best living situation for the children.
